Hearing the appeal of Mukesh, convicted in the Nirbhaya gang-rape case, the Patiala House Court has issued a new death warrant for the criminals. Now Nirbhaya’s criminal will be hanged not on 22 January but on 1 February at 6 am. A new death warrant should be issued in the court today when it was informed that Mukesh’s mercy request has been rejected by the President. The court then took this decision after looking into all aspects and issued a new death warrant and the date of hanging is February 1.
This debate took place in court:
When the court proceedings started, government lawyer Irfan Ahmed told the court that the President has rejected Mukesh’s mercy request. Along with this, he also filed an application that a new death warrant be issued to the four criminals. There is no request pending in any court at this time.
On this, the court asked whether the Guilty person was told about the mercy request being dismissed? The amicus curiae(An amicus curiae (literally, “friend of the court”; plural, amici curiae) is someone who is not a party to a case and may or may not have been solicited by a party and who assists a court by offering information, expertise or insight that has a bearing on the issues in the case) Vrinda Grover told the court whether the Guilty person has been officially informed of the mercy request being dismissed? I do not trust media reports because it is a question of someone’s life and death.
On this, the judge asked the government lawyer to inform the accused officially about the mercy request being rejected. On this, the government lawyer said that after confirming this with the Tihar administration, he will tell the court in an hour.
Mukesh’s lawyer did not allow to meet him – amicus curiae
At the same time, the defense lawyer said that the documents of Akshay and Pawan have also not been provided. At this, Vrinda Grover told the court that the jail did not let Mukesh even meet his lawyer. The judge then asked the government lawyer to hold a meeting of Mukesh and his lawyer.
When the hearing resumed, the public prosecutor told the judge that Mukesh had been officially informed that his mercy request had been dismissed. The judge, while looking at the entire case, found that every Guilty person here is filing different appeals one after the other on different dates. He asked, how long will all this last?
After this, Vrinda Grover filed an application on behalf of Mukesh that he should be provided with the documents so that he can use the provisions which are thereafter the mercy request is dismissed. After this, Sessions Judge Satish Arora issued a new death warrant keeping all the things in mind, according to which the criminal will now be hanged on February 1, 2020, at 6 am.
